Summary: Focus Area is a youth-led, non-accredited tutoring program. We are not a school, not affiliated with the Department of Education, and not responsible for how third parties choose to evaluate our transcripts or letters. By using Focus Area you agree to these terms.
1. About Focus Area
Focus Area is an educational tutoring service operated under Next Gen Studios US ("Next Gen," "we," "us," "our"), a youth-led project based in Delaware, USA. Focus Area provides the Applied Learning Skills (APLS) curriculum, the Applied Learning Test (ALT) assessment system, a student progress dashboard, proficiency transcripts, and letters of recommendation to enrolled students.
Focus Area is currently in development. Access to any paid features will not be charged until the program formally launches.
2. Acceptance of Terms
By accessing or using Focus Area — including joining the waitlist, enrolling in the program, or accessing any curriculum content — you ("user," "student," "parent," "guardian," or "institution") agree to be bound by these Terms of Service. If you do not agree, do not use the service.
Parents and guardians are responsible for reviewing and agreeing to these terms on behalf of minor students.
3. Not a School or Accredited Program
Important: Focus Area is a supplemental tutoring service. We are not a school, not a homeschool program, and not accredited by any regional, national, or state accrediting body. We are not affiliated with the US Department of Education, any state board of education, WASC, or any other governmental or academic regulatory body.
Focus Area does not replace compulsory schooling, homeschool requirements, or any accredited academic program. Users are solely responsible for ensuring they meet all applicable educational requirements in their jurisdiction.
The APLS curriculum, ALT assessments, transcripts, and letters of recommendation issued by Focus Area are issued by Focus Area as a private organization and carry no governmental or institutional accreditation.
4. The APLS Curriculum
The Applied Learning Skills (APLS) curriculum is an independently developed K–12 educational framework created by Next Gen Studios US. APLS is our proprietary system — it is not derived from, endorsed by, or affiliated with any government curriculum standard.
The curriculum is subject to ongoing development and improvement. Content, structure, and subject areas may change at any time as we advance the program. All enrolled users will receive access to the current version of the curriculum applicable to their plan.
5. The ALT & NGS Score
The Applied Learning Test (ALT) is Focus Area's proprietary assessment, administered at the end of each grade level. The ALT is scored against the Next Gen Standard (NGS) — our internally defined proficiency benchmark. The current NGS passing score is 75 out of 100.
The NGS score and ALT are proprietary benchmarks created by Next Gen Studios US. They do not correspond to, replace, or represent any government standardized test, state exam, or accredited academic assessment.
Focus Area uses AI-assisted grading to evaluate ALT results. While we make reasonable efforts to ensure accuracy and eliminate bias, we do not guarantee that AI grading is error-free. Students who believe their score was calculated incorrectly may contact us to request a manual review.
Students who pass the ALT at the NGS threshold are eligible for grade-level advancement within the Focus Area program and for issuance of a proficiency transcript and, where applicable, a letter of recommendation. Advancement within Focus Area does not constitute academic advancement within any external school or institution.
6. Transcripts & Letters of Recommendation
Focus Area issues proficiency transcripts and letters of recommendation as a private organization. These documents reflect a student's performance within the Focus Area APLS program only.
- Transcripts are issued by Focus Area Education, a program of Next Gen Studios US.
- Transcripts and letters are not government-issued, state-recognized, or accredited academic records.
- How third parties — including schools, colleges, employers, or institutions — choose to evaluate Focus Area transcripts and letters is entirely at the discretion of those parties. Focus Area makes no guarantee that any transcript or letter will be accepted, recognized, or acted upon by any external party.
- Letters of recommendation are issued based on plan eligibility or on meeting the 4.0 GPA requirement on the Standard plan. Focus Area reserves the right to withhold letters if academic conduct or platform conduct policies have been violated.
By enrolling in Focus Area, you acknowledge and accept that our transcripts and letters of recommendation are documents issued by a private tutoring service and not by any accredited or government-affiliated institution.
7. Accounts & Subscriptions
Access to Focus Area's paid features requires an active subscription. Plans vary in the number of student accounts included and the features available. Users are responsible for maintaining the security of their account credentials and for all activity that occurs under their account.
Family plans allow up to 10 student accounts under one subscription. Account sharing beyond the plan limit is prohibited. We reserve the right to suspend or terminate accounts found to be in violation of plan limits.
Subscriptions auto-renew unless cancelled. You may cancel at any time through your account dashboard. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time unless required by applicable law.
8. Payments & Refunds
All payments are processed through third-party payment processors. Next Gen Studios US does not store payment card information. By providing payment information you agree to the terms of the applicable payment processor.
Focus Area is currently in development and no charges are made during the waitlist period. Pricing displayed on the Focus Area page is subject to change before launch.
Refund requests are handled on a case-by-case basis. We are not obligated to provide refunds except where required by law. To request a refund, contact support@nextgenstudiosus.com.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Next Gen Studios US, Focus Area, and their representatives are not liable for any indirect, incidental, consequential, or special damages arising from your use of the service, including but not limited to:
- Reliance on APLS curriculum content for any purpose outside the program
- A third party's refusal to accept or recognize a Focus Area transcript or letter of recommendation
- Interruption, errors, or inaccuracies in the service or AI-assisted grading
- Loss of data, access, or progress within the platform
- Any academic or professional outcomes resulting from use of the service
Focus Area is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content in the program.
10. User Conduct
Users agree not to misuse the Focus Area platform. Prohibited conduct includes but is not limited to:
- Submitting false or misleading information to obtain a transcript or letter of recommendation
- Cheating on ALT assessments or misrepresenting assessment results
- Sharing account credentials beyond plan limits
- Attempting to reverse-engineer, scrape, or copy APLS curriculum content
- Harassing or abusing Next Gen Studios US staff or other users
Violations may result in immediate suspension or termination of your account without refund.
11. Third-Party Services
Focus Area may use or link to third-party tools, platforms, or services (including payment processors, communication tools, and hosting providers). Next Gen Studios US is not responsible for the practices, content, or availability of any third-party service. Use of third-party services is subject to those services' own terms and privacy policies.
12. AI Use Disclosure
Focus Area uses artificial intelligence tools to assist with ALT grading and proficiency scoring. Our AI grading system is designed to evaluate student performance based on knowledge and reasoning, without racial, sexual, or religious bias. We make reasonable efforts to ensure fairness but do not guarantee that AI-assisted grading is entirely free of error.
Students who believe their score was unfairly assessed may request a manual review by contacting us at support@nextgenstudiosus.com.
13. Minors & Parental Consent
Focus Area is accessible to users of all ages, including minors. We do not collect data from children under 13 beyond what is necessary to provide the service, consistent with COPPA guidelines. Parents or legal guardians must provide consent for students under 13 to use the platform.
Parents and guardians are responsible for monitoring their child's use of the platform and for ensuring that use of Focus Area complies with any applicable local educational requirements.
14. Youth-Led Project Disclosure
Next Gen Studios US is a youth-led project. The founder and primary operator is a minor under Delaware law. This means that certain legal agreements, financial contracts, and business transactions are managed with parental or guardian involvement where required by law. Focus Area is operated as an educational project, not a formal registered business entity at this time.
This disclosure is provided in the interest of full transparency. It does not diminish your rights as a user or the enforceability of these terms to the extent permitted by applicable law.
15. Intellectual Property
All content within Focus Area — including but not limited to the APLS curriculum, ALT assessments, the NGS scoring framework, dashboard design, branding, and written materials — is the intellectual property of Next Gen Studios US. You may not reproduce, distribute, or use any portion of Focus Area's content outside of the program without written permission.
Students retain ownership of their own submitted work. By submitting work through the platform, you grant Focus Area a limited license to use that work for grading and assessment purposes.
16. Termination
We reserve the right to suspend or terminate any account at any time for violation of these terms, abuse of the platform, or for operational reasons. Where possible, we will provide advance notice. Termination does not entitle you to a refund unless required by law.
You may terminate your account at any time by cancelling your subscription and contacting support.
17. Changes to Terms
We may update these Terms of Service at any time. When changes are made, the effective date at the top of this page will be updated. Continued use of the service after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
18. Governing Law & Disputes
These Terms of Service are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising from these terms or from use of Focus Area should first be directed to Next Gen Studios US via email for direct resolution before pursuing any formal legal action.
