Section 01
Nature of the Project & Scope of This Policy
This Privacy Policy ("Policy") applies to Next Gen Studios, Next Gen Academy, The War Room, and all associated shows, programs, courses, events, digital platforms, forms, and any other creative or educational initiative conceived, directed, or operated under the Next Gen umbrella by Jaaziel Bournes (collectively referred to herein as "Next Gen," "the Project," "we," "us," or "our").
Next Gen Studios is not a corporation, registered business, limited liability company, nonprofit organization, or any other formally incorporated commercial entity. It is an independent, youth-led creative and educational project operated by a minor residing in the United States. Data collection, storage, processing, and review operations are carried out solely for the purpose of operating, improving, and managing the Project — not for commercial data brokerage, advertising networks, or any other commercial purpose unrelated to the Project's mission.
This Policy is intended to be as transparent as possible regarding what information is collected, why it is collected, how it is used and protected, who may access it, and what rights and choices you have with respect to your information. By accessing or using any Next Gen platform, submitting any form, enrolling in any program, or participating in any Next Gen initiative in any capacity, you expressly consent to the data practices described in this Policy.
Because the Project is youth-led and continuously evolving, you acknowledge that data handling practices, tools, platforms, and processes may change at any time. Continued use of any Next Gen service after any update constitutes your acceptance of the revised Policy.
Section 02
Information We Collect
Next Gen Studios collects information in two primary ways: information that you voluntarily provide to us through direct interaction with our platforms and services, and limited technical or usage information that may be collected automatically through the operation of the platforms and third-party tools we use.
2.1 — Information You Voluntarily Provide
When you interact with any Next Gen form, application, enrollment process, contact submission, DMCA claim, or any other input mechanism, you may provide us with information including but not limited to: your full name or alias, email address, Discord username, phone number, portfolio or social media links, written descriptions of your experience or work, uploaded files or screenshots, payment-related identifiers, and any other information you choose to include in a submission.
2.2 — Information Collected Automatically
Through the normal operation of our digital platforms and the third-party services integrated into them, limited technical data may be collected automatically. This may include general device type, browser type, operating system, approximate geographic region (not precise location), pages visited, time spent on pages, and similar usage analytics collected in aggregate for the purpose of improving the experience. We do not use this data to build individual user profiles for advertising purposes.
2.3 — Information Collected Through Communications
If you contact Next Gen Studios via email, social media, Discord, or any other communication channel, we may retain a record of that communication, including your contact details and the content of your message, for the purpose of responding to your inquiry and maintaining operational records.
You are not required to provide any personal information to browse publicly accessible portions of Next Gen platforms. However, certain features — such as submitting applications, enrolling in programs, or filing DMCA claims — require the provision of specific information as a condition of use.

Form Submissions & Third-Party Review
Next Gen Studios uses third-party form processing and communication services to receive, store, and manage the information you submit through any form, application, or data entry point on any Next Gen platform. At the time of this Policy's effective date, Next Gen Studios utilizes FormSubmit (formsubmit.co) as a primary form handling service, among other tools that may be added or changed over time.
By submitting any form, application, message, or data to Next Gen Studios, you expressly acknowledge and agree to all of the following:
- Your submission will be transmitted to and processed by one or more third-party service providers who facilitate form processing, email delivery, data storage, or related functions. These providers operate under their own privacy policies and terms of service, which you are encouraged to review independently.
- Your submitted information may be reviewed by Next Gen Studios youth leadership, approved associates, volunteers, or other individuals affiliated with the Project for the purpose of evaluating your submission, responding to your inquiry, managing your participation, or making project-related decisions.
- We may use the contact information you provide to reach out to you via email, Discord, or other messaging platforms for purposes including but not limited to responding to your submission, communicating opportunities, requesting additional information, or sending project-related updates.
- You consent to this review, transmission, and communication process as a condition of submitting any information through any Next Gen platform or service.
Section 04
How We Use Your Information
All information collected by or submitted to Next Gen Studios is used exclusively for purposes directly related to the operation, management, and improvement of the Project. Specifically, your information may be used for any of the following purposes:
- Reviewing and processing applications and submissions — including contributor applications, developer applications, DMCA claims, course enrollments, and any other form-based interaction with the Project.
- Managing participation — tracking and administering your involvement in any Next Gen program, event, course, or initiative, including communicating relevant updates, changes, and decisions.
- Communicating with you — responding to your inquiries, providing updates on your application or submission status, notifying you of relevant opportunities, or following up with requests for additional information.
- Improving the quality and structure of services — using aggregate usage data and feedback to understand how our platforms and programs are being used and to make improvements over time.
- Ensuring safety, compliance, and project integrity — identifying and addressing misuse, violations of our Terms of Service, unauthorized access, or other conduct that may compromise the security or integrity of the Project.
- Internal planning and operations — using information for internal administrative and operational purposes, including scheduling, resource planning, and contributor management.
Section 05
Data Sharing Practices
Next Gen Studios does not sell, rent, trade, or commercially distribute your personal information to any third party. We believe your information is yours, and we handle it with that principle in mind to the best of our ability given the tools and platforms we rely on to operate the Project.
However, in the course of normal operations, your information may be shared in the following limited and necessary circumstances:
5.1 — Third-Party Service Providers
We use third-party tools and platforms to operate various functions of the Project, including form processing, email communication, payment handling, video hosting, and analytics. When you interact with these services, your information may be transmitted to and processed by those third parties as part of their normal operation. Examples of such services may include FormSubmit, Webador, PayPal, Stripe, Cash App, YouTube, Roblox, Discord, and similar platforms.
5.2 — Internal Project Associates
Certain information — particularly application details, submission content, and contact information — may be shared internally with trusted Next Gen associates, youth leaders, or approved volunteers who need access to that information for the purpose of evaluating submissions, managing participants, or fulfilling project responsibilities.
5.3 — Legal Compliance
In the unlikely event that Next Gen Studios is required to disclose information pursuant to applicable law, regulation, court order, or other legal process, we may comply with such requirements to the extent required by law. We will make reasonable efforts to notify you of any such disclosure unless prohibited from doing so by law or court order.
In all typical operational circumstances, your personal information remains within the Next Gen project ecosystem and is not shared with unaffiliated third parties for their own purposes.
Section 06
Communications & Outreach
By voluntarily providing your contact information through any Next Gen form, application, enrollment, or other submission mechanism, you expressly authorize Next Gen Studios to contact you using the information provided. Communications from Next Gen Studios may be sent via email, Discord, or other messaging platforms and may include any of the following:
- Responses to your submitted form, application, inquiry, or DMCA claim.
- Status updates regarding the review or processing of your submission.
- Notifications about programs, courses, events, or initiatives you have enrolled in or expressed interest in.
- Requests for additional information necessary to process your submission or manage your participation.
- General project-related announcements, updates, or news that may be relevant to you as a participant, contributor, or community member.
- Compensation-related communications for contributors who have an active or pending payment arrangement with the Project.
Section 07
Cookies & Tracking Technologies
Next Gen Studios' platforms are hosted through and integrated with various third-party services, including Webador, which may use cookies, pixel tags, local storage, and similar tracking technologies as part of their standard platform operation. These technologies may be used to maintain session continuity, remember preferences, analyze traffic patterns, and support the functionality of embedded third-party tools.
Next Gen Studios itself does not independently deploy proprietary cookie systems or tracking scripts. However, because our platforms rely on third-party hosting and service infrastructure, cookies placed by those services may be active when you visit or interact with any Next Gen platform. You acknowledge and accept that such cookies are a standard function of the third-party platforms used to deliver Next Gen's services.
Most web browsers allow you to manage, restrict, or delete cookies through browser settings. Doing so may affect the functionality of certain features on Next Gen platforms. Next Gen Studios is not responsible for any degradation in platform performance resulting from your cookie management choices.
Section 08
Data Security & Youth-Led Limitations
Next Gen Studios takes reasonable and proportionate steps to protect the information you provide from unauthorized access, alteration, disclosure, or destruction. These steps include limiting internal access to submitted information to only those individuals who need it for project-related purposes, relying on third-party platforms with their own security standards and infrastructure, and avoiding the unnecessary retention of personal data beyond operational needs.
However, you expressly acknowledge and accept all of the following important limitations:
- Next Gen Studios is a youth-led project operated by a minor. It is not a professional security organization, cybersecurity firm, or enterprise-grade data processor. Our data protection capabilities are proportionate to our scale and operational context.
- No system, platform, or data transmission method can guarantee absolute protection against unauthorized access, data breaches, technical failures, or other security incidents.
- The security of your information is also dependent on the third-party platforms through which it is transmitted and stored. Next Gen Studios does not control the security practices of these third parties.
- You transmit personal information to Next Gen Studios at your own risk, and by doing so, you agree that Next Gen Studios shall not be liable for any data loss, unauthorized access, breach, or security incident that occurs beyond our reasonable control.
Section 09
Retention & Deletion of Information
Next Gen Studios retains your personal information for as long as is reasonably necessary to fulfill the purposes for which it was collected, to manage your ongoing participation in any Next Gen program or initiative, to maintain records necessary for the integrity and continuity of the Project, or to comply with any applicable internal guidelines or legal obligations.
In practice, this means:
- Application and contributor submission data may be retained for the duration of your involvement with the Project and for a reasonable period thereafter for record-keeping purposes.
- DMCA claim records are retained indefinitely as part of our legal documentation and dispute history, in accordance with the resolution finality provisions of our Terms of Service.
- Communication records — including emails and form submissions — may be retained for operational reference purposes.
- Payment-related information is retained to the extent necessary for compensation record-keeping, but Next Gen Studios does not store full payment credentials such as card numbers or bank account details.
Section 10
Youth-Led Review & Decision Making
All data handling, review processes, and decisions related to submitted information are carried out by Next Gen Studios' youth leadership or approved associates acting under the direction of project leadership. This includes the review of applications, DMCA claims, contributor submissions, and any other information submitted through Next Gen platforms.
By participating in any Next Gen service or submitting any information, you expressly acknowledge and accept all of the following:
- Review and decision-making processes are conducted by youth, and decisions may reflect the judgment, perspectives, and priorities of young people leading the Project at any given time.
- Decisions may be subjective, may change over time, and are not subject to formal appeal processes except at the sole discretion of Next Gen Studios leadership.
- Processes, timelines, and outcomes related to the review of your information may vary and are not guaranteed to occur within any specific timeframe.
- Next Gen Studios assumes no liability for misunderstandings, delays, disagreements, or any other adverse experience arising from the youth-led nature of our review and decision-making processes.
- Your participation in any Next Gen service and your submission of any information is entirely voluntary and made at your own discretion and risk.
Section 11
Third-Party Services & External Links
Next Gen Studios' platforms and communications may contain links to, integrations with, or references to third-party websites, services, and platforms. These may include but are not limited to Roblox, Polytoria, YouTube, Discord, Spotify, PayPal, Cash App, FormSubmit, and Webador. These third-party services are independent of Next Gen Studios and operate under their own privacy policies, terms of service, and data handling practices.
By using any Next Gen service that involves a third-party platform, you acknowledge that your interaction with that third-party service is governed by that service's own policies, not this Privacy Policy. Next Gen Studios is not responsible for the privacy practices, security standards, data handling, or terms of any third-party service.
We encourage you to review the privacy policies of any third-party platforms you interact with in connection with Next Gen services. The presence of a link to or integration with a third-party service does not constitute an endorsement of that service's privacy or data practices by Next Gen Studios.
Section 12
Children's Privacy (COPPA Notice)
Next Gen Studios is a youth-focused project and, as such, some of its programs and platforms may be accessible to children under the age of 13. Next Gen Studios is aware of and committed to complying with the Children's Online Privacy Protection Act ("COPPA") to the extent applicable to its operations.
Next Gen Studios does not knowingly collect personal information from children under the age of 13 without verifiable parental or guardian consent. If you are under the age of 13, please do not submit any personal information to Next Gen Studios without first obtaining consent from a parent or legal guardian.
If Next Gen Studios becomes aware that it has inadvertently collected personal information from a child under the age of 13 without appropriate consent, it will take prompt steps to delete that information from its records. If you are a parent or guardian and believe that your child has submitted personal information to Next Gen Studios without your consent, please contact us immediately at support@nextgenstudiosus.com and we will make reasonable efforts to locate and delete the information in question.
Because Next Gen Studios is itself operated by a minor, we are particularly attentive to the privacy and safety of all participants, including young people. We encourage all participants, regardless of age, to be thoughtful about what personal information they choose to share through any digital platform.
Section 13
Your Rights & Choices
Subject to the limitations of Next Gen Studios' youth-led operational capacity and the policies outlined in these Terms, you have certain rights with respect to the personal information you have provided to the Project. These rights include:
- Right to Access: You may request a summary of the personal information Next Gen Studios holds about you by contacting us at support@nextgenstudiosus.com. We will make reasonable efforts to respond to such requests within a reasonable timeframe.
- Right to Correction: If you believe any information we hold about you is inaccurate or incomplete, you may request that we correct it by contacting us in writing.
- Right to Deletion: You may request deletion of your personal information, subject to the retention exceptions described in Section 09 of this Policy.
- Right to Opt Out of Non-Essential Communications: You may request to be removed from non-essential outreach at any time, as described in Section 06.
- Right to Withdraw Consent: Where your participation in a Next Gen service is based on your consent, you may withdraw that consent at any time by ceasing use of the service and notifying us in writing. Withdrawal of consent does not affect any processing already carried out prior to withdrawal.
Section 14
Governing Law & Jurisdiction
This Privacy Policy and any dispute arising out of or relating to the collection, use, storage, or handling of your personal information by Next Gen Studios shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to this Privacy Policy shall be filed exclusively in the state or federal courts located in the State of Delaware, and both parties hereby irrevocably consent to the personal jurisdiction of such courts for that purpose.
Section 15
No Guarantees or Warranties
All Next Gen platforms, services, and communications are provided on a strictly "as-is" and "as-available" basis. Next Gen Studios makes no representations, warranties, or guarantees — express, implied, or statutory — regarding any of the following:
- The accuracy, completeness, or currency of any information stored or processed in connection with your use of Next Gen services.
- The uninterrupted, error-free, or secure operation of any Next Gen platform or third-party service integrated therein.
- The outcomes of any review, decision, or evaluation process involving your submitted information.
- The ongoing availability of any specific service, platform, or communication channel.
Section 16
Changes to This Privacy Policy
Next Gen Studios reserves the right to update, modify, amend, or replace any portion of this Privacy Policy at any time, for any reason, and without prior individual notice. All changes are effective immediately upon being posted to the relevant Next Gen platform or otherwise communicated through official Next Gen channels.
It is your responsibility to review this Privacy Policy periodically to remain informed of how your information is being handled. Your continued access to or use of any Next Gen service following the posting of any update to this Policy constitutes your full and unconditional acceptance of the revised Policy. If you do not agree to any updated version of this Policy, your only recourse is to immediately discontinue use of all Next Gen services and submit a deletion request as described in Section 09.
